2 dead, 1 with serious personal injury after rear-end collision

Another gruesome fatal accident occurred recently at about 7:30 p.m. on Friday, Feb. 16, according to the Florida Highway Patrol. It started in the westbound lane of State Road 100 in Bunnell where a pickup truck was stopped while waiting to make a left turn onto County Road 35. A car traveling in the westbound lane could not stop in time and crashed into the rear of the pickup, sending it into the oncoming traffic in the eastbound lane where an oncoming pickup truck crashed into it. Death and personal injury ensued as two occupants in the rear-ended pickup were ejected and died, and a third occupant was hospitalized with serious injuries, per the authorities.

The two deaths consisted of the 43-year-old male driver of the fatality vehicle and a 35-year-old passenger in it. The 26-year-old surviving passenger was hospitalized at the Halifax Medical Center in Daytona. Police report that the driver of the offending car, a 48-year-old female of Crescent City, was also taken to Halifax with serious injuries.

Police reports indicate the possibility that she was driving impaired. She is responsible for the deaths and injuries that occurred directly as a result of her failure to stop and avoid colliding with the pickup. In a case with such substantial damages, the tortfeasor's liability insurance policy sometimes does not cover a fair payout to the victims.

In that event, the estates of the two decedents and the injured passenger will look to their own underinsured motorists' coverage for additional recompense pursuant to Florida law.
